El artículo aborda la responsabilidad médica penal por omisión en situaciones de emergencia de salud, debido a las dudas que aún existen sobre el accionar médico en estas circunstancias y las posibles consecuencias jurídicas por negligencia, impericia e imprudencia. La responsabilidad médica incluye la obligación moral de responder de los propios actos y reparar o indemnizar las consecuencias perjudiciales para terceros. Se identifican las falencias en las normativas ecuatorianas con relación al actuar médico en situaciones de emergencia de salud y (...) se busca aportar a la academia con publicaciones de conocimiento. Se analizan los elementos normativos y fácticos de la responsabilidad médica penal por omisión en situaciones de emergencia de salud en la República de Ecuador, y se busca identificar el marco normativo en la legislación ecuatoriana para superar la inadecuada actuación médica en estas situaciones. El conocimiento de la normativa legal contribuye a superar la responsabilidad médica penal por omisión en situaciones de emergencia en el Ecuador y se menciona y se analiza el art.146 del COIP que es la normativa vigente. El artículo concluye que el objetivo no es criminalizar la práctica médica, ya que no toda muerte es homicidio y no todo proceso judicial implica el encarcelamiento de los involucrados. (shrink)

This paper is divided into a surveying and argumentative part and a slightly longer documentary part, which is meant to verify or at least make more plausible claims made in the first part. The first part deals in broad outline with the relationship of Frank and von Mises to the Vienna Circle of Logical Empiricism on the one hand and to the physicists and mathematicians in the German-speaking world on the other. The varying special positions, partly the non-conformity of the (...) two Austrian scientists are emphasized, in particular, their adherence to Ernst Mach’s epistemology and their shared interest in probability theory and applied mathematics. The impact of emigration and the after-effects in the U.S. are discussed. This leads to new insights into the fine structure of the Vienna Circle and the latter’s relationship to German academia within ‘Weimar Culture’. P. Forman’s interpretation (1971) of von Mises’ position is critically discussed. The second, documentary part, uses recently discovered correspondence between Frank and von Mises, and, to a lesser extent, von Mises’ personal diary. It aims at further substantiating some of the introductory theses and will at the same time provide material for a thorough biographical appreciation of the two scholars and friends. (shrink)

In the history of science the ‘Elixir Tychonis’ was rather neglected till today. This elixir consists of three prescriptions. The first was published in Cista medica by Thomas Bartholinus, the third in the biography of Brahe written by Gassendi . The famous edition of Opera omnia Brahei by Dreyer contains the three prescriptions in the Vol. IX; Dreyer used only the manuscript Langebekiana Nr. 179 under consideration of the printed texts differing from the manuscript. The discovery of the probable unknown (...) original text for the printed text in Cista medica was made by us in the University Library of Basle; by further inquiries were found two neglected manuscripts in the University Library of Erlangen. We restricted our examinations not only to palaeographical comparison of the three new manuscripts but we extended also the historical analysis to the interpretation of the underlying alchemical ideas of Tycho Brahe. In the history of chemistry the ‘chymist’ Brahe is rather unknown; therefore it seemed necessary to show by comparison with the original contemporary sources the position of our Danish astronomer towards Paracelsism in the sixteenth and seventeenth centuries. Este trabajo está dirigido a fundamentar cómo a través de un proceso de innovación tecnológica se establecieron relaciones entre la universidad, la sociedad y el sector empresarial. La introducción de los productos biológicos en los laboratorios de diagnóstico médico y su impacto en los servicios fue el elemento fundamental que identificó la relación universidad-sociedad, mientras que la transferencia tecnológica de la obtención de biológicos a la unidad productora y comercializadora articuló a la academia con el mundo empresarial. Los modelos seguidos (...) para la gestión de la actividad de innovación le otorgaron al proceso un carácter específico y aseguraron su pertinencia, por lo que constituyó un logro científico-tecnológico. Se demostró un caso peculiar y concreto de fortalecimiento de las capacidades de interacción de las universidades con entidades productivas y de servicios, de modo que se enriqueció la función extensionista del centro de altos estudios. This article is based on a process of technical innovation that allowed establishing a relationship in which the university, society and the managerial sector were involved. The introduction of the biological products in medical diagnosis labs and its impact on services were the main elements that distinguished the university-society relationship, while the technological transfer to the unit of the biologicals obtained, articulated the university and the managerial field. Models put into practice for innovation management granted the process a specific character and ensured its relevance, that´s why it is considered a scientific-technological achievement. The process demonstrated a peculiar case of interaction between the university and production entities. (shrink)

Paracelsus was a transmutational alchemist: For most of his career, he believed that one metal could be turned into another. In an alchemical text, the De renovatione et restauratione, he explored the theoretical foundations of transmutation and hinted at recipes for bringing it about. He proposed that from plants, gems, metals, and minerals might be prepared a class of marvelous medicaments, which he called prima entia (first entities). Each primum ens had particular uses, but the entia were all supposed to (...) be able to revitalize the human body and cleanse it of disease. Certain entia could also transmute metals. The De renovatione et restauratione affirmed the metaphysical centrality, in goldmaking and medicine alike, not just of purification or alteration but of renewal and transformation. It expressed the author’s eschatological excitement at God’s works of wonder, whether within or above nature. (shrink)

Summary The enthusiasm of Renaissance humanists for classical learning greatly influenced the development of botany in the late fifteenth and sixteenth centuries. Humanist scholars restored the treatises of Theophrastus, Pliny, Galen and Dioscorides on botany and materia medica to general circulation and argued for their use as textbooks in Renaissance universities. Renaissance botanists' respect for classical precepts and models of the proper methods for studying plants temporarily discouraged the use of naturalistic botanical illustration, but encouraged other techniques for collecting and (...) communicating new observations: herbaria, botanical gardens and field trips. Over the last few years, the pharmaceutical industry intensified marketing activity in Poland. One of the most important ways of promotion are visits by pharmaceutical sales representatives in physicians’ offices. Representatives during those meetings are using different sorts of tactics to manipulate physicians such as: gift-giving, free meals, travel subsidies, “fake” research, ‘white Saturdays’, sponsored teaching and conferences. An ethical ambiguity can be easily find in this work. The paper describes briefly the results of the research concerning the influence of (...) the relationship between physicians with the pharmaceutical companies on prescribing habits which were conducted in other countries. The article presents law regulations and ethical codes present in Poland, but it concentrate on describing the results of 31 in-depth interviews with pharmaceutical sales representatives conducted between the June – November 2007. The main aim of this paper is to show how important are ethical and law standards for the pharmaceutical sales representative. Do they know it? Does companies take care about proper training and information in the area for their employees? Work ethics of the pharmaceutical sales representative is very important, and should be discussed. Drugs are special kind of goods which can influence people health and sometimes even lives so we should pay attention to the ways medicaments are advertise and promote. (shrink)

Journeys of the self - have long been a fascination within the annals of human thought, nowhere more so than in the philosophical traditions of ancient Greece and Rome. At the heart of this exploration lies the concept of the "Constructed Self," a lens through which we examine how individuals' identities are molded, shaped, and defined by the prevailing norms, values, and social structures of their time. Within the realms of philosophy in Ancient Greece and Rome, thinkers grappled with questions (...) of individual identity, the influence of society on the self, and the interplay between personal agency and external forces. Among the guiding principles of many ancient Greek and Roman philosophers was the idea of "following nature." Rooted in the belief that living in accordance with nature's laws leads to a harmonious and virtuous life, this principle deeply influenced conceptions of the self. Additionally, the advancements in Greek medicine, particularly the humoral theory attributed to figures like Hippocrates and Galen, offered a lens through which philosophers explored the balance of bodily and mental health. This paper embarks on the journeys of the self through the philosophical landscapes of antiquity. By examining the works of philosophers such as the Stoics, Epicureans, Platonists, and Aristotelians, we seek to unravel the intricate tapestry of beliefs surrounding the formation and understanding of the self. These ancient thinkers offer profound insights into how social roles, cultural norms, and communal values intersect to create the framework within which individuals come to know and define themselves. In this exploration, we consider how the concept of the constructed self in Ancient Greece and Rome illuminates not only the individual's place within society but also the dynamic interplay between the personal and the communal. By scrutinizing the philosophical underpinnings of ancient Greek and Roman thought, we aim to uncover the enduring relevance of these ideas for understanding the nature of identity, agency, and selfhood in our contemporary world. Drawing on archival material in Utrecht and Rotterdam, we examine the geophysical surveys of Indonesia and Brazil carried out by Elie van Rijckevorsel during the period 1870 to 1890. We pay special attention to the complex interactions among university academics, government administrators and ministers of state, and private, ‘gentlemanly’ specialists. Making an appearance, in addition to Van Rijckevorsel, are the Utrecht polymath Christophorus Hendricus Diedericus Buys Ballot , the colonial and metropolitan astronomer Jean Abraham Chrétien Oudemans , colonial geophysicist Pieter (...) Adriaan Bergsma , French-Brazilian astronomer Emmanuel Liais , Colonial Minister Isaac Dignus Fransen van de Putte , and others. The decision of Van Rijckevorsel, an independently wealthy man of learning, to carry out a magnetic survey of the Malay archipelago spurred colonial authorities at The Hague to endow the finest geomagnetic observatory in the tropics. Van Rijckevorsel's interactions with academia and government suggest the extent to which wealthy Dutch patricians readily accepted government patronage for their scientific undertakings. A late-nineteenth-century Dutch ‘gentleman of science’ is seen to differ rather widely from his English counterpart of an earlier generation. Pope John Paul II’s Apostolic Constitution Ex Corde Ecclesiae is not a new document. It was published almost twenty years ago – in 1990. Nevertheless it seems that it’s not very well known in Poland. Although it is mainly addressed to Catholic universities, one has to admit that it gives insightful description of academic world’s nature in general. This constitution recalls basic objectives and calling of academia. Ex Corde Ecclesiae is an important voice that speaks about the mission and identity (...) of university, which can be understood in two perspectives. First – in European dimension – it reminds us where Old Continent’s intellectual heritage and achievements come from. Secondly – in our Polish perspective – Apostolic Constitution Ex Corde Ecclesiae – may be a valuable signpost for our developing and reforming academic world, which not always seems to understand its identity and mission properly. As a style of writing and a form of communication, the modern scientific report enables the creation, sharing and continuous updating of natural knowledge in such a manner that the idiosyncrasies of ordinary language are reduced to a minimum. This article examines how the standards for scientific reporting were ‘born’ in the seventeenth century and their legacy. The first part of the article reviews the existing literature on this topic. The second part outlines the key features of the scientific report (...) and the common standards for scientific reporting. The third part presents detailed historical evidence to trace the emergence of these standards in seventeenth-century England. The final part discusses why the scientific report means so much for the progress of science, for understanding the history of science and science popularization, and even for the development of academia more generally. Matching his hearts in number, the three books under review delve into the various Greek, Italic, and Latin influences on Ennius’ eighteen-book Annales, exploring the epic’s literary heritage and reception. One might rightly claim that in the wake of these important contributions (1088 pages for 623 fragments), we have firmly entered an aetas Enniana. The elephant in the room for all those interested in the poem is, of course, its highly fragmentary state of preservation. Instead of serving as an insurmountable obstacle, the scholarly process of interpreting fragmentary texts actually emerges as a shared feature of the methodologies on display in these otherwise quite different works. While Fisher and Goldschmidt push the limits of what an incomplete epic can communicate, Elliott more skeptically tackles the nature of transmission and its impact on our knowledge of the text.Ennius’ Oscan heart, representing his Italic heritage, takes center stage in Fisher’s study. Many readers will find most original and striking his arguments for the epic resonance and formulaic quality of “traditional” Latin phrases and their links with languages such as Umbrian and Oscan. Fisher relies throughout on the meaningful co-occurrence of communicative words, “traditional collocation” (3), and the use of language from various “traditional” cultural fields such as ritual, prayer, kinship, and the military (he adopts Lowell Edmunds’ concept of “system reference,” 5). According to Fisher, Ennius’ use of these culturally marked forms of language, shaped during the period of the central Italian koine\ (seventh to fourth centuries b.c.e.), allows his epic to include and enact an elevated tone appropriate to the inherited demands of his genre. While Ennius’ revolutionary turn to the hexameter may initially suggest a decision to abandon all that is old (or perhaps old-fashioned) about “native” literary culture, the pervasive presence of the Italic militates against severing Ennius from the lifeblood pumped through his Oscan heart. In fact, the dialogue between “foreign and familiar” aspects of culture is key to Fisher’s demonstration of how the Italic past emerges as a ghostly mediator and occasional replacement of superficially Greek and Homeric elements (10, 56, 85).With a presumed audience of Latinists, it is somewhat surprising that the introduction, “Ennius and the Italic Tradition,” devotes little time to outlining his rather unique methodology. But Fisher prefers to show rather than tell. On page 5 he jumps right into an analysis of Skutsch Ann. 232 (non semper vostra [End Page 713] evortit nunc Iuppiter hac stat), the language and context of Jupiter Stator in Cicero Cat. 1, and the Oscan Jupiter Versor: he convincingly connects Oscan Iovi Versori with Ennius’ evortit... Iuppiter (8). While the particulars of the argument take a winding course through various temples and texts, it is the act itself of probing seemingly commonplace language to reveal linguistic and cultural significance that highlights the best of what Fisher has to offer.Chapter 2, “The Annals and the Greek Tradition,” traces the Italic features of the epic through what one might call cross-lingual window-allusion. For example, Ann. 1 (Musae quae pedibus magnum pulsatis Olympum) contains a well-known substitution of the Greek Musae for his predecessors’ Camenae, but Fisher draws our attention to the “native Latin tradition” of the Salian priests’ tripudium behind pedibus... pulsatis: “if the collocation pedem pulsare is a traditional expression for... Volume X presents a critical edition with commentary of all the texts published by Constant between July 1815 and April 1818. We are dealing here with political journalism, an instrument of public opinion deployed with great virtuosity by Constant to realise his liberal programme, with texts on political theory and the fundamental debates on the state budget, with publications composed in connection with the 1817 parliamentary elections. This volume contains an engagement with one of Chateaubriand’s key works (La Monarchie selon (...) la Charte), articles on the politics of the day and publications on important contemporary personalities such as Madame de Staël or Joseph Fouché. The importance of the texts always reaches beyond their particular concern to encompass fundamental principles of liberalism in Restoration Europe. (shrink)
